1. General
These terms govern the purchase, cancellation and refund of the digital services offered online by DERİN AKADEMİ EĞİTİM VE DANIŞMANLIK HİZMETLERİ LTD. ŞTİ. ("Derin Akademi" / "the Seller") through the Project Atlas platform ("the Platform"). Every purchase made through the Platform is assessed together with the Distance Sales Agreement and the Pre-Contractual Information Form approved at the time of purchase.
2. Nature of the service
Project Atlas is a digital service performed instantaneously in an electronic environment (intangible digital content), in which users rehearse difficult conversations aloud with artificial intelligence characters and receive feedback from an artificial intelligence coach. There is no delivery of any physical product. Access to the service is provided by purchasing a subscription for a period and/or a credit / usage pack. One "credit" means the right to one rehearsal (conversation + coach evaluation).
3. The right of withdrawal and its exception
Under the Regulation on Distance Contracts, a consumer has as a rule a fourteen (14) day right of withdrawal without giving a reason. However, pursuant to Article 15 of the same Regulation, the right of withdrawal cannot be exercised for services performed instantaneously in an electronic environment and intangible goods delivered instantaneously to the consumer, or for services whose performance has begun with the consumer's approval.
At the time of purchase the user accepts that they expressly request instantaneous performance of the service in an electronic environment and that they will lose the right of withdrawal in respect of the part whose performance/use has begun. The refund rules within that framework are as follows.
4. Refund rules
- Credit never used / a subscription never started: where the service concerned has not been used at all within 14 days of the purchase date (no rehearsal has been started and no session under the subscription has taken place), the full price is refunded on request.
- Credit used / spent: the moment a rehearsal is started, the credit concerned counts as a service performed and no refund is made in respect of that credit.
- A rehearsal left unfinished (attributable to the Seller): if a rehearsal cannot be completed for a reason not attributable to the user, such as a system error or a dropped connection, the credit spent is made available for use again (released); no separate refund of money is required.
- Subscription: no refund is made on subscriptions whose performance has begun (at least one session has taken place); the user may cancel their subscription at any time, and the cancellation takes effect at the end of the current period, stopping renewal. Access to the service continues until the end of the period.
5. How to request a refund
Refund requests are sent to derin@derinakademi.net with the name, the order/transaction number and the reason for the request. Approved refunds are made to the credit card used for payment, through the iyzico infrastructure, within 14 days of the request being approved. How long the amount takes to appear on the card depends on the bank or payment institution concerned.
6. Pricing and taxes
All prices are shown on the Platform with VAT included. The Seller reserves the right to change prices for future sales; price changes do not affect past purchases.
7. Resolution of disputes
Within the monetary limits determined each year by the Ministry, the user may apply to the Consumer Arbitration Committee or the Consumer Court of their place of residence or of the place where the transaction was carried out.
